Renovating in built-up areas requires careful planning. One key factor is how proposed works affect neighbouring properties.

This is especially important when shared walls or excavations are involved. As a trusted party wall surveyor in Hove, Focus Consulting often manages these scenarios.

In this case study, our director, Iain Staines, acted as the agreed party wall surveyor for a complex residential renovation. The case shows the value of early advice, impartial oversight, and clear documentation.

The Renovation: Structural Works Trigger Party Wall Procedures

The homeowner planned major works to combine two flats into a single dwelling. The project included removing a fire escape, roof alterations, and the installation of a heat pump and solar panels. Excavation for new foundations was also required.

Because the proposed works affected a shared wall and included excavation close to neighbouring structures, the Party Wall etc. Act 1996 applied.

Notices and the Onset of Dispute

The building owner served two notices on the adjoining property owners. One covered works to the shared wall (Party Structure Notice), and the other addressed excavation within three metres.

The adjoining owners did not respond within 14 days. This resulted in deemed dissent, which triggered a formal dispute under the Act.

Schedule of Condition: Creating a Baseline

Before construction began, Focus Consulting prepared a Schedule of Condition for the neighbouring property.

Our survey included inspections of external elements such as the roof and chimney, as well as internal areas like bedrooms and the loft. We recorded broken tiles, failed render, and hairline cracks. High-quality photos supported the written record.

This created a clear baseline in case of future damage.

Draughting the Party Wall Award

We then issued a Party Wall Award. This document outlined the scope of works, included the condition report, and referenced architectural drawings.

It also detailed protective measures, working hours, site access, and debris removal. The award granted rights for follow-up inspections and required the contractor to carry out work to a professional standard.

Any damage caused had to be made good.

Although the adjoining owners initially failed to respond, the dispute was resolved efficiently. Appointing a single, agreed party wall surveyor helped both sides avoid conflict.

This collaborative approach protected both parties and kept the project on track.
